1. Company Information
Coral Expeditions Costa Rica is a tourism business operated by KENSOF SRL, Costa Rican legal identification number 3-102-899394, based in Uvita, Puntarenas, Costa Rica. In these Terms and Conditions, “Coral Expeditions Costa Rica,” “the Company,” “we,” “us,” and “our” refer to KENSOF SRL.

2. Acceptance of These Terms
By requesting, booking, paying for, or participating in one of our tours or services, you confirm that you have read, understood, and accepted these Terms and Conditions and our Cancellation Policy. The person making a reservation for a group is responsible for sharing these terms with every participant included in the booking.
3. Reservations and Confirmation
A request for availability does not constitute a confirmed reservation. A booking is confirmed only after Coral Expeditions Costa Rica provides written confirmation and receives any deposit or payment required for the selected activity.
Reservations are subject to availability, minimum participation requirements, vessel availability, permits, protected-area entrance availability, weather, ocean conditions, and operational considerations.
Bookings made through GetYourGuide or another third-party provider may also be subject to that provider’s payment and cancellation procedures. The conditions accepted through that platform will apply to the extent required for that reservation.
4. Prices and Payments
The applicable price is the price stated in the written booking confirmation. Clients are responsible for reviewing the tour, date, departure and check-in times, participants, inclusions, exclusions, and total price before payment.
For Corcovado National Park and Caño Island tours, a 50% deposit is required to confirm the reservation. This deposit is generally non-refundable when the client cancels because it may cover park permits, commissions, taxes, reservations, and organization costs. The Company cancellation provisions below remain applicable.
5. Check-In and No-Shows
Clients must arrive at the confirmed meeting point at the stated check-in time. The boat or tour may not be able to wait for late arrivals. A client who does not appear, arrives too late to participate, or voluntarily leaves after an activity begins will be considered a no-show and will not be entitled to a refund, except where required by law.
Clients are responsible for transportation, parking, and any service not expressly included in the booking confirmation.
6. Itineraries and Operational Changes
Routes, schedules, snorkeling or swimming locations, hiking trails, departure points, return times, and included activities may change for safety, conservation, weather, ocean conditions, park instructions, or operational reasons. These adjustments do not automatically constitute a cancellation when the principal tour can still be operated safely and reasonably. Our captain and guides have final authority over operational and safety decisions during the activity.
7. Wildlife Sightings
Coral Expeditions Costa Rica operates in natural environments. Whales, dolphins, turtles, birds, tapirs, and other wildlife are wild animals, and sightings cannot be guaranteed. The absence of a particular species does not entitle a client to a refund or repeat tour.
8. Cancellation by Coral Expeditions Costa Rica
We may cancel or postpone a tour when reasonably necessary because of unsafe weather or ocean conditions, natural phenomena, government or National Park restrictions, insufficient participation, mechanical problems, or another circumstance that prevents safe or legal operation.
When Coral Expeditions Costa Rica cancels a tour, the client will first be offered the opportunity to reschedule, subject to availability. If the client cannot participate on another available date, the Company will issue a 100% refund of the amount paid directly to Coral Expeditions Costa Rica for the cancelled tour.
We are not responsible for separate expenses such as flights, accommodations, rental vehicles, meals, or transportation purchased from other providers.
9. Client Cancellations and Rescheduling
Client cancellations, refund eligibility, and date-change requests are governed by our Cancellation Policy. Rescheduling is subject to availability, vessel capacity, protected-area entrance availability, and any additional non-refundable permit or third-party costs required for the new date.
10. Health and Participation Requirements
Clients must disclose before the tour any medical condition, disability, pregnancy, allergy, mobility limitation, or other circumstance that could affect safe participation. Tour-specific restrictions shown in the tour description or confirmation form part of these Terms.
Certain activities may not be suitable for pregnant travelers, very young children, people with limited mobility, or people with particular medical conditions. Clients should seek medical advice when unsure whether they can safely participate. Our personnel may carry basic first-aid equipment, but they are not medical professionals. Emergency care or evacuation provided by third parties may be charged to the client.
11. Safety and Client Conduct
Participants must follow instructions from the captain, guide, park officials, and Company personnel; use required safety equipment; and avoid endangering themselves, other participants, wildlife, or the environment.
We may refuse or discontinue participation without a refund when a person is under the influence of alcohol or drugs, behaves dangerously or abusively, refuses safety instructions, damages property, harasses others, or creates an unreasonable risk. Parents and legal guardians are responsible for supervising minors in their care.
12. Personal Belongings
Clients are responsible for protecting phones, cameras, documents, money, luggage, and other belongings from loss, theft, rain, seawater, or damage. We recommend suitable waterproof protection. Coral Expeditions Costa Rica is not responsible for loss or damage unless it results from liability that cannot legally be excluded.
13. Insurance and Responsibility
Coral Expeditions Costa Rica maintains civil liability insurance applicable to its operations. This is not a substitute for personal travel, accident, medical, evacuation, or cancellation insurance.
To the extent permitted by Costa Rican law, we are not responsible for loss caused by circumstances outside our reasonable control, a client’s failure to follow instructions, undisclosed medical conditions, unrelated third parties, or the inherent and ordinary risks of marine and nature activities. Nothing in these Terms excludes any responsibility or consumer right that cannot lawfully be excluded.
14. Website Information and Intellectual Property
We make reasonable efforts to keep website information accurate. Photographs are illustrative, itineraries and wildlife encounters may vary, and information may be updated. Unless otherwise stated, website text, photographs, videos, logos, and other original material belong to Coral Expeditions Costa Rica or are used with permission and may not be used commercially without written authorization.
15. Privacy and Communications
Personal information provided for inquiries and reservations will be handled in accordance with our Privacy Policy and applicable Costa Rican data-protection law. We may contact clients with information needed to manage a reservation, including schedule, weather, safety, meeting-point, or cancellation updates.
16. Applicable Law
These Terms and Conditions are governed by the laws of the Republic of Costa Rica. Mandatory consumer rights and competent dispute-resolution procedures established by Costa Rican law remain applicable.
17. Changes to These Terms
We may update these Terms when our services, procedures, or legal obligations change. The version applicable to a reservation will be the version available when the booking is confirmed, unless a later change is required by law or expressly accepted by the client.
